Welcome to Sapphire Coded ("Sapphire Coded", "we", "us", "our"). These Terms of Service ("Terms") govern your use of our website, our social media channels, and any artwork, pottery, jewelry, commissions, workshops, or sessions we offer (together, the "Services"). By browsing our website, placing an order, or booking a session, you agree to these Terms. If you do not agree, please do not use our Services.

1. Who We Are

Sapphire Coded is a Dubai-based art and jewelry practice creating original flower-inspired paintings, handmade pottery, and jewelry, and hosting jewelry making sessions.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order or book a session. By using our Services, you confirm that the information you provide is accurate and complete.

3. Our Products

3.1 Handmade and original. Our paintings, pottery, and jewelry are handmade. Small variations in shape, size, colour, texture, glaze, and finish are part of what makes each piece unique and are not defects.

3.2 Natural materials. Gemstones, beads, and other natural materials vary in colour, clarity, pattern, and inclusions. Your piece may differ slightly from the photos shown.

3.3 Product images. We do our best to display our work accurately, but colours may look different depending on your screen, lighting, and device.

3.4 Availability. Many pieces are one of a kind or made in small batches. Availability is not guaranteed, and we may withdraw a piece at any time before your order is confirmed.

3.5 Pottery use. Unless a piece is clearly described as food-safe, our pottery is decorative and should not be used for food, drink, or heating.

3.6 Jewelry materials and skin sensitivity. Jewelry may contain metals or materials that can irritate sensitive skin. Please check the material details on the product page and contact us before purchase if you have concerns. Remove jewelry before swimming, showering, exercising, or using chemicals to keep it looking its best.

3.7 Care. Handmade items can be delicate. Please follow any care instructions provided and handle pieces with care.

4. Pricing and Payment

4.1 All prices are listed in UAE Dirhams (AED) unless stated otherwise. Where applicable, prices include UAE Value Added Tax (VAT).

4.2 Payment is due in full at the time of order or booking, unless we agree a deposit arrangement for a commission. Payments are processed securely by third-party payment providers. We do not store your full card details.

4.3 We may correct pricing errors at any time. If a pricing error affects an order you have placed, we will contact you and give you the option to proceed at the correct price or cancel for a full refund.

5. Orders

5.1 Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation or dispatch your item.

5.2 We may refuse or cancel an order, for example due to stock issues, pricing errors, suspected fraud, or inability to deliver to your address. If we cancel a paid order, you will receive a full refund.

6. Commissions and Custom Work

6.1 Commissioned paintings, pottery, and jewelry are made specifically for you. The scope, price, timeline, and any deposit will be agreed in writing (email or message) before work begins.

6.2 Deposits are non-refundable once work has started. Once production is underway, commissions cannot be cancelled or substantially changed without our agreement.

6.3 Because our work is handmade and artistic, we will follow your brief in good faith, but the finished piece will reflect our artistic style and small variations are expected.

6.4 Timelines for commissions are estimates. We will keep you informed of any delays.

7. Shipping and Delivery

7.1 Delivery areas, costs, and estimated delivery times are shown on the product page or at checkout. Delivery times are estimates, not guarantees.

7.2 Delays caused by couriers, weather, public holidays, incorrect addresses, or events outside our control are not our responsibility.

7.3 Please make sure your delivery address and phone number are correct. If an order is returned to us because of incorrect details or failed delivery attempts, additional delivery charges may apply.

7.4 Artwork and fragile pottery are carefully packaged, but risk of loss or damage passes to you once the item has been delivered to the address you provided.

8. Returns, Refunds, and Exchanges

8.1 Final sale. Because our pieces are handmade, original, and often one of a kind, all sales are final. We do not accept returns or exchanges for change of mind. Commissioned and custom items are always final sale.

8.2 Damaged, defective, or incorrect items. If your item arrives damaged, defective, or different from what you ordered, contact us at info@thesaloonedit.com within 48 hours of delivery with your order number and clear photos. After reviewing, we will offer a replacement, repair, or refund at our discretion, subject to your rights under UAE law.

8.3 Approved refunds are issued to the original payment method. Processing times depend on your bank or card provider.

8.4 Nothing in these Terms limits any rights you have under applicable UAE consumer protection laws.

9. Jewelry Making Sessions and Workshops

This section applies to any jewelry making session or workshop you book with us.

9.1 Booking. A place is reserved only once payment is completed and you receive confirmation. Session prices, dates, times, and capacity are shown at the time of booking.

9.2 Your cancellations. If you cancel at least 48 hours before the start of the session, you may request a refund or a credit toward a future session. Cancellations made less than 48 hours before the session, and no-shows, are non-refundable. Where possible, you may transfer your place to another person by letting us know in advance.

9.3 Our cancellations and changes. We may reschedule or cancel a session, for example due to low bookings, illness, or circumstances beyond our control. If we do, we will notify you and offer you a place at the new date, a credit, or a full refund.

9.4 Safety and materials. Sessions involve small parts, beads, wire, and hand tools, which can be sharp and are a choking hazard for young children. Please follow the instructions of our team, keep small parts away from children, and take care with tools. You participate at your own risk and are responsible for your personal belongings. Please tell us in advance about any allergies or needs that may affect your participation.

9.5 Conduct. We aim to keep our sessions welcoming, respectful, and safe. We may ask anyone who is disruptive, disrespectful, or unsafe to leave without a refund.

9.6 What you make. Pieces you make in a session belong to you. Handmade jewelry made in a session is not professionally finished or tested for durability, and we are not responsible for wear, breakage, or skin reactions.

9.7 Photos and video. We may take photos and videos at our sessions for use on our website and social media. If you do not want to appear in our content, please tell us at the start of the session and we will respect that.

10. Intellectual Property

10.1 All content on our Services, including our name, logo, brand identity, designs, artwork, product photos, text, and website, is owned by or licensed to Sapphire Coded and is protected by intellectual property laws.

10.2 Artwork. When you buy a painting, pottery piece, or jewelry item, you own the physical object only. Copyright and reproduction rights in the design and artwork remain with Sapphire Coded. You may not reproduce, print, copy, or sell images of our work or make copies of our designs without our written permission.

10.3 Personal, non-commercial sharing of our content on social media with proper credit to Sapphire Coded is welcome.

11. Your Content and Social Media

If you tag us, send us photos, or share content about our pieces or sessions, you give us permission to repost and display that content on our website and social channels, with credit to you where possible. You confirm you have the right to share it. If you would like content removed, contact us and we will take it down.

12. Acceptable Use

You agree not to:

• use our Services for any unlawful or fraudulent purpose;
• attempt to gain unauthorised access to our website, systems, or other users' information;
• interfere with the operation of our website;
• upload harmful code or misleading, abusive, or infringing content; or
• copy, imitate, or resell our work as your own or misrepresent your affiliation with us.

13. Third-Party Services and Links

Our Services may use third-party platforms, such as e-commerce providers, payment processors, and delivery companies, and may link to third-party websites. We are not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk.

14. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you acknowledge that you have read it.

15. Disclaimers

Our Services and products are provided "as is" and "as available". To the fullest extent permitted by law, we do not guarantee that our website will be uninterrupted or error-free, or that any piece will meet every expectation. Gemstones and materials are described in good faith, and unless we state otherwise in writing, our jewelry is not sold with any gemological certification or investment value. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, Sapphire Coded and its owner will not be liable for any indirect, incidental, or consequential loss arising from your use of our Services. Our total liability for any claim relating to an order or booking is limited to the amount you paid for that order or booking. Nothing in these Terms limits liability that cannot be limited under UAE law.

17. Indemnity

You agree to compensate and hold harmless Sapphire Coded from any claims, losses, or expenses arising from your breach of these Terms or your misuse of our Services.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a new "Last updated" date. Continued use of our Services after changes are posted means you accept the updated Terms. Orders and bookings already placed are governed by the Terms in place at the time you placed them.

19. Termination

We may suspend or end your access to our Services at any time if you breach these Terms or misuse our Services.

20. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. We encourage you to contact us first so we can try to resolve any issue amicably. If a dispute cannot be resolved, it will be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

21. General

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any right does not mean we waive it. These Terms, together with our Privacy Policy and any Shipping or Returns Policy on our website, make up the entire agreement between you and Sapphire Coded.
